These terms govern your use of Flip (the "Service"), a web application that turns PDFs into shareable flipbooks, provided by marketculture ("we", "us", "our"). By creating an account, uploading a file, buying credits, subscribing, or otherwise using the Service, you agree to these terms. If you do not agree, do not use the Service.
1. Who can use Flip
You must be at least the age of majority in your jurisdiction or have permission from a parent or legal guardian. If you use the Service for an organization, you must have the authority to bind that organization to these terms. You are responsible for keeping your account credentials confidential and for all activity under your account.
2. The Service
Flip lets you upload PDF documents, converts them into flipbook viewers, and generates shareable links. Features, storage limits, pricing tiers, and included credits may change over time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
3. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- Use the Service for any unlawful, fraudulent, or misleading purpose;
- Upload or share content that infringes intellectual property or privacy rights;
- Upload malware, spam, or content designed to disrupt or harm other users;
- Attempt to probe, scan, or breach the security of the Service;
- Reverse engineer, resell, redistribute, or circumvent usage limits of the Service;
- Scrape, harvest, or extract data from the Service except through supported means.
4. Your content
You retain all rights to the PDFs and other content you upload. You grant us a limited, non-exclusive, worldwide licence to host, process, store, and display your content solely to operate and provide the Service to you and to the audiences you share it with. You are responsible for having all necessary rights to your content.
5. Our intellectual property
The Service, including the software, design, branding, and documentation, is owned by marketculture and its licensors. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your selected plan.
6. Pricing, payments, and refunds
Paid features are billed through our reseller. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides customer service inquiries and handles returns. For billing, subscription, cancellation, and tax mechanics, please refer to Paddle's buyer terms. Refund handling is described in our Refund Policy.
Credits purchased on the Service are valid for one (1) year from the date of purchase and are consumed when you publish a flipbook. Subscription plans grant access for the billing period paid for and renew automatically until cancelled.
7. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these terms, fail to pay amounts due, create a security or fraud risk, or repeatedly violate our acceptable-use rules. You may stop using the Service at any time.
8. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind. We do not warrant that flipbooks will render identically across every device or browser.
9. Limitation of liability
To the fullest extent permitted by law, marketculture will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Service. Our aggregate liability under these terms will not exceed the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim.
10. Indemnity
You agree to indemnify and hold harmless marketculture from claims, damages, and expenses arising out of your content, your use of the Service in violation of these terms, or your violation of any law or third-party right.
11. Changes to these terms
We may update these terms from time to time. If changes are material, we will notify you where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
12. Governing law
These terms are governed by the laws of India. You agree to the exclusive jurisdiction of the courts located in India for any dispute arising out of or relating to these terms, subject to mandatory consumer protection rights available to you.
